1. About these terms

1.1 These terms are an agreement between Youthworks Media, an imprint of Anglican Youthworks (the Publisher, we, us), and the church or organisation that purchases a subscription (the Subscriber, you).

1.2 By ticking the acceptance box and completing your purchase, you agree to these terms. The person accepting confirms they are authorised to bind the Subscriber.

1.3 In these terms:

Work means the New Creation Kids resources supplied under your subscription, including all text, illustrations, data, design and any updates or supplementary materials, in any format.

Authorised Users means the Subscriber's clergy, staff and volunteers.

Adapted Materials has the meaning given in clause 3.2A.

Derivative means any derivative work, compilation, summary, template or other material based on or derived from the Work.

Subscription Period means the period for which you have paid, including any renewal.

Site means newcreationkids.org.

1.4 The licence notice printed in the Work forms part of these terms. If the two differ, these terms prevail.

2. Subscription, fees and renewal

2.1 Each subscription covers one church only. A church with several sites or congregations, or a group of churches, needs a separate subscription for each church unless we agree otherwise in writing.

2.2 The fee is shown on the Site at checkout and includes GST. Fees are payable in advance for each Subscription Period.

2.3 Your subscription renews automatically at the end of each Subscription Period at the then-current fee, unless you cancel before the renewal date. We will notify you by email 14 days before each renewal, including the renewal date and fee.

2.4 You may cancel at any time through your account on the Site or by emailing sales@youthworks.net. Cancellation takes effect at the end of the current Subscription Period. Except as required by law, fees already paid are not refundable.

2.5 We may change the fee for future Subscription Periods by giving you at least 30 days' notice by email before the change applies to you.

3. Licence

3.1 The Work is licensed, not sold. For the Subscription Period, we grant you a non-exclusive, non-transferable licence for your Authorised Users to use the Work for your church's own internal purposes, within one church only.

3.2 You may download the Work and store it on your church's own internal systems for that purpose only.

3.2A Adapting the Work. Authorised Users may adapt the Work for your church, including by editing, shortening, expanding, reordering or reformatting it, adding local details, images or branding, and incorporating it into your church's own templates, programs and communications (Adapted Materials). AI tools may be used to help prepare Adapted Materials, provided that, where the tool allows, the Work is not made available for training the tool.

3.3 Permitted use. Authorised Users may use the Work and Adapted Materials to teach children in your church's own programs, at the church's premises or gatherings. For that purpose, they may display the Work and Adapted Materials and print copies of the pages needed for a session. Children taking part in a session may keep printed pages given to them in that session for their personal use. Authorised Users may also use Adapted Materials in your church's own communications with its members, children's families and volunteers, such as newsletters, emails, notices, church apps and parent information. Short extracts and promotional content may be published on your church's own website and social media, but whole sessions, lessons or other substantial parts of the Work must not be made publicly available. Nothing in this clause permits the Work or Adapted Materials to be shared with any other church or organisation.

3.3A Attribution. Adapted Materials that reproduce a substantial part of the Work must include the line: “Adapted from New Creation Kids © Youthworks Media 2026. Used under licence.” Adapted Materials must not be presented as your own work or imply that we have approved the changes.

3.4 Restrictions. Except as permitted by these terms or by law, you must not, and must ensure no Authorised User or other person through you does, in whole or in part:

(a)copy, reproduce, modify, adapt, translate, abridge, rearrange or otherwise alter the Work, other than to create Adapted Materials;

(b)create any Derivative, other than Adapted Materials;

(c)sell, resell, license, sublicense, lend, rent, distribute, publish, transmit or otherwise make available the Work or any Derivative to any third party, whether or not for payment, other than to Authorised Users or as permitted above;

(d)except as permitted above, upload, store or make the Work or any Derivative available on any publicly accessible system, or on any system shared with or accessible to anyone other than Authorised Users, or incorporate it into any other product or service;

(e)retain, use or rely on the Work, any Adapted Materials or any Derivative after the subscription ends;

(f)use the Work or any Derivative to train, develop or improve any artificial intelligence, machine learning or automated system; or

(g)remove, conceal, obscure, crop or alter any Youthworks Media or New Creation Kids name, logo or branding, or any copyright notice, page footer or attribution, appearing in the Work, including on any page displayed or printed, except that Adapted Materials may carry the attribution line above in place of that branding. All such branding and notices must be kept intact and visible on unadapted pages.

3.5 You are responsible for your Authorised Users' compliance with these terms. If others outside your church are interested in using the Work, please direct them to subscribe at newcreationkids.org.

4. End of subscription

4.1 When your subscription ends for any reason, all rights to access and use the Work end immediately. You must stop using the Work, any Adapted Materials and any Derivative and delete or destroy all copies in your possession or control, including downloaded and printed copies and any Adapted Materials published on your church's website or social media, other than printed pages already given to children under clause 3.3 and communications already sent to members and families before the subscription ended.

4.2 If you materially breach these terms, we may give you written notice describing the breach. If you do not remedy it within 14 days, we may end your subscription by further notice. If the breach cannot be remedied, we may end it immediately by notice.

5. Ownership

5.1 The Work is owned by the Publisher and its licensors, including Biblica, Inc. for Scripture quotations and the illustrator for illustrations. No right, title or interest in the Work, any Adapted Materials or any Derivative passes to you, other than in your own original additions to Adapted Materials.

5.2 Any Derivative made in breach of these terms infringes the rights of the Publisher and its licensors. We reserve all rights not expressly granted and may enforce them by any lawful means, including injunctive relief and damages.

6. Consumer law and liability

6.1 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

6.2 To the extent permitted by law, where our liability for failing to comply with a consumer guarantee can be limited, it is limited to resupplying the Work or refunding the fee for the affected Subscription Period, at our option.

6.3 We aim to keep the Work accurate and available, but we do not guarantee uninterrupted access to the Site.

6.4 We are not responsible for the content, accuracy or suitability of any Adapted Materials, including any changes you make to the Work.

7. Privacy

7.1 We collect and handle your personal information in accordance with our privacy policy at Youthworks privacy policy, to manage your subscription and communicate with you about it.

8. Changes to these terms

8.1 We may update these terms by giving you at least 30 days' notice by email. Updated terms apply from your next renewal date. If you do not agree, you may cancel before that date.

9. General

9.1 These terms are governed by the law of New South Wales, Australia, and each party submits to the courts of that state.

9.2 You may not transfer your subscription or these terms to anyone else without our written consent.

9.3 If any part of these terms is invalid or unenforceable, it is severed and the rest continues in effect.

Using this resource: what you need to know

Your church has a subscription to New Creation Kids. It is licensed to your church only, for your church's own ministry. You're welcome to adapt it to suit your church.

When the subscription ends

Stop using the resource and any adapted versions and delete or destroy any copies you hold, including downloads and printouts. Pages already given to children and their families can stay with them, and you don't need to recall newsletters or emails already sent.
